Abstract

This work comments on a judgment of the Supreme Court on investment companies and a specific kind of local tax. This judgment departs from the trend set by the same Court. In addition, the case is decided on the ground on a corollary of the principle of tax legality: the restrictive interpretation, one of the most important elements to control public powers and to guarantee individual rights.
