Constitutionalisation of the responsibility of the State administration: imputation for consecutive environmental damages

Abstract

This article analyzes if it is justifi ed in the framework of the Constitutionalisation of the law an equal procedure for the consecutive environmental damage against the general damages inside the system of administrative responsibility of the State. In consideration of the characteristics of the environmental damage, it is necessary redefi ne the judgment given to the State Responsibility for the impure environmental damage, mainly by the title of the imputation. This redefi nition is necessary in reason the regimes of the state responsibility of the law do not show the reinforced protection about the heritage of the victims against their pretentions but well provided to the environment. To be more exactly, with the phenomenon of the Constitutionalisation of the law the State acts like the administrator of the collective assets. This is the reason why it is proposed redefi ne the titles of imputation on the consecutive environmental damage aspects discussed by the Jurisprudence of the contested administrative decision
