The open access to seawater: an approximation to its legal and economic nature

Abstract

The administrative and politic difficulties to regulate the use and enjoyment of seawater has led individuals wishing to take advantage of them to submit to a complex extractive regime, which presupposes certain anomalous legal structures that would justify the acquisition of an entitlement. This paper aims for a legal and economic conceptualization of the seawater to account for the regime of its extractive use, from the idea that they are common pool resources admitting their open access.
