Abstract

This paper addresses the main elements that make up the statute of the public telecommunications service concessionaire, in order to highlight some debates that stress the Chilean regulation on the matter. A brief review is given on the regulatory framework that presides over the installation, operation and exploitation of a telephone and data transmission service, as well as the institutional framework that acts as a counterpart. Likewise, the modalities that the granting of this type of concessions may adopt are specified, the requirements that the operator must meet, the reasons for their termination, as well as the main rights and obligations incumbent on the concessionaire. Based on some approaches formulated by the political-legislative discussion and by academic reflection, the author makes a critical balance regarding the current design of regulatory policy in this important sector of the Chilean economy.
