Abstract

The concept of public domain contained in art. 132 of the Spanish Constitution, is historically and comparative law unprecedented. However it is not  completely new, because in its configuration is affected by doctrinal currents and rules in force before its approval. This paper analyzes the historical, normative and doctrinal background that led to capture in the constitutional text, in a detailed and novel way, the actual meaning of this institution.
