Abstract

This article presents a conceptualization and analysis of the institution of formulation of charges. For this reason, is analyzed the national legislation, the national and comparative doctrine, and the jurisprudence. Through this investigation, it is possible to argue that the formulation of charges is an administrative act of capital importance insofar as it allows the exercise of the right to defense and the principle of contradiction within an administrative sanctioning procedure. Despite the fact that there is no law of sanctioning administrative procedure in Chile, it is possible to define this institution and establish its configuration elements.
